Land Use Planning
The Community Planning Act provides municipal councils and rural communities with the necessary tools to plan and control development in their respective communities. Kings Regional Service Commission helps these communities, along with residents of the Local Service Districts, to develop rural plans through research, analysis, comparisons and discussions.
Kings Regional Service Commission also assists clients to ensure their development choices comply with the Rural Plans of their community. One may not use or develop your property in a way that does not comply with the permitted uses and development standards for the applicable zone set out in the Rural Plan If a proposed development does not comply with the requirements of a Rural Plan an individual can make an application to amend, rezone, vary or adjust the requirements of the Rural Plan.
Amendment & Rezoning
If you intend to use or develop your property in a way that does not comply with the zoning of a Rural Plan but is consistent with the intentions of the Rural Plan, you may make application to have the zoning amended.
It is very important to discuss your proposal with planning staff before applying for a rezoning in order to obtain advice and information on how to proceed with the application. Please allow at least six months for this process.
Variances & Adjustments
Kings Regional Service Commission has the authority to approve adjustments or variances to zoning requirements. These variances and adjustments may be granted if they are considered desirable for the development of land and are in keeping with the general intentions of the Rural Plan.
It is very important to discuss your proposal with Planning staff before applying for a variance in order to obtain advice and information on how to proceed with the application. Please allow at least two months for this process.
Zoning Confirmations & Compliance Letter
A zoning confirmation letter is often requested prior to the sale of a property to obtain information on the zoning of that property. In some cases, an individual or organization may wish to ensure the current use or structure on the property complies with any known land use by-laws or building regulations.
You may wish to discuss with staff which letter would be most appropriate for your needs. Please allow a week for this process.
